STUDENT TERMS AND CONDITIONS

By enrolling in any training course or using any materials or resources (“DAS Resources”)  provided by Data Analytics, Simplified, LLC ("DAS"), you ("User," "you," or "student") agree to be bound by the following Terms and Conditions:

  1.  Refund Policy

DAS is committed to providing quality educational services. If you are not satisfied with the DAS Resources provided, you may cancel your enrollment and request a refund. If you cancel your enrollment at least seven (7) calendar days before the designated course start date, you will be eligible for a full refund of your course enrollment cost. If you cancel your enrollment within seven (7) days before the designated course start date, you may still be eligible for a partial refund of fifty percent (50%) of your course enrollment cost, provided you cancel your enrollment at least seventy-two (72) hours before the designated course start date. If you cancel your enrollment within seventy-two (72) hours of the designated course start date, you will not be eligible for any refund. However, if you fail to cancel your enrollment within seventy-two (72) hours of the course start date and are no longer able to attend that course, you may request to transfer your enrollment to a future session at no extra cost, provided you make such request and such request is acknowledged by DAS before the course begins. To request a refund, please contact [email protected] with your enrollment details. All refunds will be processed to the same form of payment initially used for enrollment.

  1.  Your Responsibilities

Once you are enrolled in a DAS course, you are responsible for preparation in advance of each online class so that you are able to gain maximum benefit from each session and your own individual study. You are responsible for participation in each online session, including conducting yourself in a business-like and professional manner for your benefit and the benefit of the DAS instructor and all other online course participants. You are responsible to maintain the confidentiality and integrity of all information and materials provided to you as part of your enrollment in any DAS course and your access to DAS Training Materials, and to maintain at all times the complete confidentiality of all such information and Training Materials. Any failure by you to fulfill your obligations and responsibilities under these Terms and Conditions may result in your dismissal from the DAS course in which you have enrolled at the sole discretion of DAS, in which event you shall not be entitled to any refund of your DAS course fees and any other amounts paid by you to DAS.

  1.  Missed Classes and Access to Recordings

 

No refunds are offered for missed classes. However, all live training sessions may be recorded by DAS. Recordings are made available exclusively to enrolled students through secure access credentials provided by DAS. Students are strictly prohibited from sharing or distributing these recordings to third parties. Unauthorized distribution will result in immediate termination of access and potential legal action.

 

  1.  Ownership, Use, and Confidentiality of Course and Training Materials

 

All training materials, including but not limited to videos, slides, recordings, workbooks, software, digital downloads, and any other related content ("Training Materials"), are the exclusive property of DAS, are considered to be trade secrets of DAS, and constitute DAS’s exclusive proprietary and confidential information. Student acknowledges that Student only has the right to access and use the Training Materials for purposes of a DAS course, and absolutely no rights, title, or interest in any Training Materials are transferred or assigned to Student other than as granted in these Terms and Conditions. Your enrollment only entitles you to access and use Training Materials as part of an active enrollment in a DAS course for a period one (1) year from your date of initial enrollment. Student agrees to keep all Training Materials confidential and agrees not to duplicate, distribute, sell, or otherwise exploit these materials commercially or non-commercially for any purpose. Any unauthorized use of any part or all of the Training Materials shall result in legal action against you for violation of these Terms and Conditions to the fullest extent of applicable law.

 

  1.  Consent to Use of Recorded Voice

 

By participating in DAS training courses or live sessions, students consent to the recording of their voice and agree that DAS may use these recordings in marketing, promotional materials, testimonials, or other forms of public communication without further notice, compensation, or approval. You may opt out of this permission by providing to DAS explicit written notice to [email protected]. This written notice must be received and acknowledged by DAS prior to you participating in any live session.

 

  1.  Dispute Resolution

 

In the event of any dispute arising from or relating to these Terms and Conditions or DAS services or resources, the parties agree first to attempt in good faith to resolve the dispute through informal negotiation. If the dispute is not resolved within thirty (30) calendar days, the parties agree to submit the dispute to binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. Arbitration proceedings shall be conducted in the State of Georgia. Each party will bear its own arbitration costs, including attorneys’ fees, unless the arbitrator determines otherwise. Judgment on the arbitration award may be entered in any court having jurisdiction thereof.

 

  1.  Disclaimer of Warranties

DAS provides all training materials and resources "as is" and without any warranty, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, reliability, or non-infringement. DAS does not warrant that the Training Materials will meet all your expectations or that access to training sessions will be uninterrupted or error-free. DAS further does not provide any warranty or guarantee that you will receive job interviews, employment offers, or employment with any employer or for any specific job as a result of participation in any DAS course.

  1.  Limitation of Liability

 

Under no circumstances will DAS or its managers, members, agents, employees, representatives, affiliates, or instructors be liable to you or any third party for indirect, consequential, incidental, special, or punitive damages arising from or related to your participation in DAS courses or use of any Training Materials. Specifically, but without limitation, DAS shall not be liable for any not responsible for data loss, technical issues, system outages, or any other similar issues experienced by you while utilizing DAS resources, Training Information, or any other aspect of DAS’s training programs. In no event will DAS’s total liability exceed the amount you have paid DAS for the specific course or service from which the claim arises.

 

  1.  Indemnification

 

You agree to indemnify, defend, and hold harmless DAS and its managers, members, agents, employees, representatives, affiliates, or instructors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to your breach of these Terms and Conditions, your unauthorized use or distribution of Training Materials, or your violation of any applicable law or regulation.

 

  1.  Modifications to Terms

 

DAS reserves the right to modify these Terms and Conditions at any time. Any changes to or modification of these Terms and Conditions will become effective immediately upon the earlier of posting to our website or providing notice to enrolled students. Continued use of DAS materials or participation in DAS courses following any modifications constitutes your acceptance of such changes.

 

  1.  Force Majeure

Neither Party shall be held liable or responsible to the other Party nor be deemed to have defaulted under or breached these Terms and Conditions for failure or delay in fulfilling or performing any term of the Agreement during the period of time when such failure or delay is caused by or results from causes beyond the reasonable control of a Party, including but not limited to fire, flood, embargo, epidemic or pandemic, war, acts of war (regardless of whether war is formally declared by any governmental body), terrorism, insurrection, riot, civil commotion, strike, lockout or other labor disturbance, failure of public utilities or common carriers, act of God, or any act, omission, or delay in acting by any governmental authority. The affected Party shall notify the other Party of such claimed force majeure circumstance(s) as soon as reasonably practicable.

  1.  Governing Law

 

If any provision of these Terms and Conditions is found by a court or arbitrator to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

 

  1.  Entire Agreement

 

These Terms and Conditions constitute the entire agreement between you and DAS concerning your enrollment in training courses, access to Training Materials, and use of any related DAS services, superseding any prior agreements or understandings.

 

  1.  Student Acknowledgments

You acknowledge that DAS is a private, for-profit organization providing training services and resources for a fee and is not an accredited educational institution under state or federal law that grants or otherwise provides educational credits toward any accredited degree program. You reaffirm your acknowledgment of and consent to use of the DAS resources and Training Materials under these Terms and Conditions, including but not limited to your acknowledgment and agreement that DAS does not guarantee in any way that you will receive offers to interview, offers of employment, or employment as a result of your participation in
